Alex Murdaugh returned to court in South Carolina on Friday as prosecutors and defense attorneys disputed evidence ahead of his upcoming retrial over the 2021 killings of his wife, Maggie Murdaugh, and their younger son, Paul Murdaugh.
The hearing focused on several unresolved issues, including additional DNA testing, ballistics evidence and questions raised by the defense about the handling of the weapons used in the killings.
Maggie and Paul were found shot to death on June 7, 2021, at the family’s rural property known as Moselle. Murdaugh, a former prominent South Carolina attorney, was convicted of their murders in 2023 and sentenced to life in prison.
However, the South Carolina Supreme Court overturned his murder convictions earlier in 2026, citing improper conduct by a court clerk that influenced jurors. The decision cleared the way for a new trial, currently scheduled to begin on April 5, 2027.

Defense seeks additional evidence
Murdaugh’s attorneys are seeking further testing of DNA evidence, including genetic material found beneath Maggie’s fingernails. They have also requested information about other shootings involving ammunition similar to that used in the killings.
The defense argues that this information could help investigate whether another person was involved. Prosecutors have questioned the relevance of some of these requests and raised concerns about the potential destruction of evidence through additional testing.
The murder weapons have never been recovered, making questions about their whereabouts a significant issue ahead of the retrial.

Questions about police handling
The defense has also cited media reports alleging that a local police official may have handled the weapons or clothing connected to the case after the killings. Attorneys argue that information about the alleged handling of evidence should be disclosed before the new trial.
The police chief’s attorney has denied that his client improperly removed or concealed evidence. Prosecutors have not publicly confirmed the defense’s allegations, and the claims remain disputed.
Murdaugh remains in prison
Murdaugh continues to serve lengthy prison sentences for separate financial crimes involving the theft of millions of dollars from clients and others. Those convictions are separate from the murder case and mean he will remain incarcerated regardless of the outcome of the upcoming retrial.
The latest hearing is part of the extensive legal process that must be completed before a new jury considers the murder charges. Both sides continue to dispute what evidence should be made available and how it may be used at trial.
Murdaugh has denied killing his wife and son. The retrial will give prosecutors and the defense another opportunity to present their arguments before a jury.
