The Texas Court of Criminal Appeals on Thursday rejected a lower court’s finding that Melissa Lucio was actually innocent of the 2007 death of her 2-year-old daughter, Mariah Alvarez. The sharply divided 5–4 decision leaves Lucio on Texas’ death row, where she has spent about 18 years.
Lucio was convicted of capital murder in 2008 after 2-year-old Mariah was found badly injured and unresponsive at the family’s home in Harlingen. Lucio told authorities that the child had fallen down a staircase. Hospital personnel found numerous bruises on Mariah and determined that she had suffered fatal blunt-force trauma to the head.

The case later became the subject of extensive questions about whether Mariah’s injuries were caused by abuse or an accidental fall. Lucio’s defense presented new scientific evidence and argued that prosecutors had failed to disclose potentially favorable evidence during her original trial.
In 2024, District Judge Arturo Nelson, who had presided over Lucio’s original trial, recommended that her conviction and death sentence be overturned and concluded that she was actually innocent. The Texas Court of Criminal Appeals, however, said Thursday that it would not adopt those findings, arguing that the lower court’s conclusions relied too heavily on Lucio’s interpretation of the evidence.
Four of the nine appeals-court judges dissented. One dissenting judge pointed to prosecutors’ concession that material evidence had been withheld during Lucio’s original trial. The court also considered evidence concerning a previously undiagnosed blood-clotting disorder that Lucio’s defense argued could help explain some of Mariah’s bruising.

Lucio narrowly avoided execution in 2022, when the same court halted her scheduled lethal injection and ordered further review of her claims. She has remained on death row since then while the legal proceedings continued.
Following Thursday’s ruling, Lucio’s attorney Vanessa Potkin said the defense plans to appeal in federal court, meaning the legal battle is not necessarily over. The ruling does not itself schedule a new execution date.
