New York Gov. Kathy Hochul sharply criticized the handling of a 2024 alleged gang rape involving a Cornell University student, saying the victim had been failed by institutions that were supposed to protect her.

During a news conference on October 2, Hochul announced that New York Attorney General Letitia James is taking over the case as a special prosecutor. James’ office has officially opened an active criminal investigation.

The case concerns allegations involving a former Cornell student who said she was sexually assaulted at the Chi Phi fraternity house in October 2024. The woman, identified as “Jane Doe” in court documents, later filed a civil lawsuit against several fraternity members, Cornell University and others.

Questions about the original investigation

Hochul said she was particularly troubled by reports that the woman told Cornell police she believed she had been raped, but that information apparently was not fully reflected in the statement provided to the Tompkins County District Attorney’s Office.

CNN also reported that the state attorney general’s investigation comes amid growing questions about what information Cornell police provided to prosecutors and how the original investigation was handled.

Tompkins County District Attorney Matthew Van Houten, whose office initially declined to bring charges in 2024, later reopened the investigation. He has said he supports James taking over the case and will cooperate with the investigation.

New York law also under scrutiny

Another major issue is New York’s sexual-assault law concerning people who voluntarily become intoxicated.

Hochul said she supports changing the law so that a person’s voluntary consumption of alcohol or drugs does not prevent authorities from considering whether the person was too intoxicated to consent. Cornell has also expressed support for changing the law and for an independent external review of its handling of the case.

The investigation is now being handled at the state level, while Cornell faces increasing scrutiny over its response to the allegations.
