The family of conservative activist Charlie Kirk has taken the first legal step toward suing Utah Valley University (UVU) and the state of Utah, alleging that serious security failures contributed to Kirk’s fatal shooting at the university in September 2025. The family submitted a formal notice of claim, a required procedural step before pursuing certain lawsuits against government entities.

Kirk was fatally shot on September 10, 2025, while speaking at an outdoor event at UVU in Orem, Utah. Authorities say the shooter fired from the rooftop of a nearby campus building while Kirk was addressing a crowd of roughly 3,000 people. Tyler Robinson, 23, has been charged with the killing and has pleaded not guilty.

In the legal notice, Kirk’s family alleges that university officials failed to conduct an adequate risk assessment, did not have a sufficient written security plan and did not provide enough security personnel for the event. The document says only six campus police officers were assigned to the event. These are allegations contained in the family’s filing and have not been established by a court.

A key allegation involves a warning about rooftop access. According to the filing, a Turning Point USA official contacted UVU Police Chief Jeffrey Long before the event about students potentially accessing a roof near where Kirk would speak. The filing says Long responded, “I got you covered,” which the family says led organizers to believe the security concern had been addressed.

The family’s notice also argues that surveillance footage could have alerted authorities to the suspected gunman before the shooting if it had been monitored in real time. The filing further raises questions about the lack of measures such as a secure perimeter, controlled rooftop access and additional law-enforcement support.

The legal filing names Utah Valley University, the State of Utah, UVU’s police department, Police Chief Jeffrey Long and former UVU President Astrid Tuminez among the prospective defendants. The family is seeking damages, though the notice itself is not yet a final lawsuit. UVU and Utah officials had not immediately responded to some requests for comment in reports published Wednesday.

Meanwhile, the criminal case against Robinson is continuing separately. Prosecutors are seeking the death penalty, and a hearing on the trial schedule is expected on October 23. Robinson has maintained his not-guilty plea.
