CNN, MS NOW and Politico have asked a federal judge to prevent the Trump administration from reinstating its ban on the three news organizations’ access to the White House while their legal challenge continues.

In a filing submitted late Monday, attorneys for the three organizations asked US District Judge Timothy Kelly to issue a preliminary injunction that would keep their White House access in place until the lawsuit is resolved. The outlets argue that the administration’s actions violate constitutional protections for the press and that they could suffer irreparable harm if the ban returns.

The request follows Kelly’s September 24 temporary restraining order, which required the White House to restore the journalists’ press credentials after they were revoked earlier this month. The order is scheduled to remain in effect for 14 days, through October 8. Kelly said the outlets were likely to succeed in showing that the administration had violated their due-process rights by removing their access without adequate notice and an opportunity to challenge the decision.

The news organizations are also challenging the ban under the First Amendment. Their lawyers argue that the administration targeted the outlets because of their reporting and that the government cannot exclude journalists from presidential coverage simply because officials object to their coverage.

The White House and Justice Department have offered a different explanation. Administration officials have argued that access to the White House is a privilege and that the restrictions were connected to national-security concerns, including allegations that some reporting revealed sensitive or classified information. The Justice Department has defended the administration’s authority to impose the restrictions.

The dispute continued even after Kelly ordered the outlets’ access restored. The filing points to the White House’s decision to prevent CNN from participating in the presidential television pool during President Donald Trump’s September 26 trip to Tennessee. The other television networks declined to provide a replacement for CNN, temporarily disrupting the traditional pool arrangement.

CNN, MS NOW and Politico told the court that these events demonstrate why a longer-lasting injunction is necessary. The administration, meanwhile, maintains that the president has authority over access to highly restricted locations and has continued to dispute the outlets’ legal arguments.

The case is part of a broader series of disputes between the Trump administration and news organizations over access to the president and other government officials. The court’s next major decision will determine whether the temporary protection remains in place while the underlying lawsuit proceeds.
