A new Trump administration immigration rule that could make it harder for some legal immigrants to obtain green cards is set to take effect Friday, September 18, as lawsuits challenging the policy continue in federal court.
The rule expands the federal government’s ability to consider an immigrant’s use—or potential future use—of certain means-tested public benefits when deciding whether the person could become a “public charge.” The policy applies to people seeking lawful permanent residency, including immigrants already living legally in the United States.
The Trump administration says the change is intended to reinforce the principle that immigrants seeking permanent residency should be financially self-sufficient. The Department of Homeland Security said the policy is aimed at protecting public resources and reducing dependence on taxpayer-funded assistance.
The new policy reverses a narrower approach adopted by the Biden administration in 2022. Under that rule, immigration officials generally focused on certain cash assistance programs and did not count benefits received by an applicant’s family members in the same way. The Trump administration’s new rule rescinds that 2022 framework.
Immigrant advocates and Democratic-led states and local governments have challenged the policy in court. Lawsuits filed in federal court argue that the broader definition could discourage eligible immigrants and their families from using programs such as food assistance and Medicaid, even when they qualify for those benefits.
One concern is that applicants could avoid seeking government assistance out of fear that doing so—or being judged likely to need it—could negatively affect their immigration applications. CNN reported that the rule does not provide a simple list of every benefit that could be considered; instead, it gives DHS authority to consider means-tested public benefits when evaluating public-charge concerns.
The legal challenges mean the policy’s implementation could still face changes as federal courts consider the lawsuits. For immigrants applying for permanent residency, the outcome of those cases could determine how broadly the government can consider public-benefit use in future green-card decisions.
